Terms & Conditions

Payment:  a NON-REFUNDABLE payment of $50 is required to secure the date of the event.   The remaining balance is due 14 days prior to the event date. A $50 refundable incidental deposit is required for all Soft Play Parties and is due 24 hours prior to the date of the event. The incidental deposit will be returned to the renter in the same tender it was received after an inspection of all equipment has been completed by the supplier without any noted damages.

Cancellation: The $50 deposit used to secure the event date is non-refundable. However, the renter may choose to transfer the deposit to secure an alternate event date if the renter provides the supplier a 10-day notice of the cancellation prior to the event and alternate dates are available.

Use of Equipment:

The renter is responsible to be present during set up and dismantling and during the rental period. ADULT SUPERVISION IS REQUIRED AT ALL TIMES FOR SOFT PLAY RENTALS.

The indoor area in which the equipment is to be utilized must be clean, free of pet hair and smoke-free. The outdoor area should be level, mowed, and dry.

The renter is responsible to ensure enough space is provided for the use of the equipment. The supplier will not remove, move or alter any furniture or other objects in the area intended for use. The supplier reserves the right to cancel, at its discretion, the rental of the equipment, if the supplier is not satisfied that the area, intended for use of the equipment, is suitable. If the supplier chooses to cancel the rental equipment, the $50 deposit will be withheld but all other payments returned to the renter. The equipment should only be used as intended. Pets and food are not permitted on the equipment. Breakfast trays may be used for food but should be set on the floor not on the equipment itself. Only the supplier is permitted to dismantle any of the equipment. The supplier will not return the $50 incidental deposit should the supplier find any damage to the equipment however, the supplier may, at its discretion impose partial refunds depending on the extent of damage.

Liability: The supplier will take every care during the setup and dismantling of its equipment however, the supplier can not be held responsible for any damage to any person or object, prior to, after or during the rental period. The renter hereby agrees no to hold the supplier liable for any injuries to persons or pets prior to, after or during the rental period. The renter further agrees not to hold the supplier liable for any damage to any real or personal property, including but not limited to damage to walls, floors, carpet, or furniture, prior to, after, or during the rental period. The renter agrees not to bring any claims or actions against the supplier for any damage or harm resulting to any person, pet, real or personal property caused prior to, after or during the rental period.

Photography: Whimsy & Giggles reserves the right to use photographs taken at your event in any promotional media controlled by us. Rest assured that we will never use identifying information in these images. If you would like an image removed, please contact us immediately via email or text. The terms and Conditions of the agreement is binding on any guest, visitor and affiliate of the renter during or after the course of the rental period, regardless of whether the Agreement has been signed by the renter or 3rd party.
